Terms of Service

RDPHosted, LLC offers services and products, collectively referred to as "Services and Products," as described in the Server Order Form, Service Level Agreement, and Service Exhibit (collectively referred to as "Service Descriptions") to the customer ("Customer") identified in the Service Descriptions. These Terms and Conditions, along with the Service Descriptions, any attachments, and addenda are referred to as the "Agreement."

Account Setup / Email and Phone Number on file

We will set up your account after receiving payment and screening the order for potential fraud. You must provide a valid phone number for order setup. Additionally, you must provide us with an email address that is not @ the domain(s) you are signing up under. We will use the primary email address on file to contact you in case of an abuse issue or if we need to contact you. You must ensure that the email address on file is current and up-to-date at all times. In high-risk transactions, it may be necessary to provide government-issued identification and possibly a scan of the credit card used for the purchase. Providing false contact information of any kind may result in the termination of your account. Orders that do not meet these requirements may be considered fraudulent and be denied.

Account Content

All services provided by RDPHosted, LLC may only be used for lawful purposes and practices. Indian Government laws apply to every customer, and you must indemnify and hold RDPHosted, LLC harmless from any claims resulting from the use of our services. The use of our services to infringe upon any copyright or trademark is strictly prohibited, including but not limited to unauthorized copying of music, books, photographs, or any other copyrighted material. Any offer of sale of any counterfeit merchandise of a trademark holder will result in the immediate termination of your account. If you believe that your copyright or trademark is being infringed upon, please email [email protected]. Examples of unacceptable material on VPS, RDP Servers, and Dedicated Servers are listed in the Acceptable Usage Policy. We reserve the right to refuse service to anyone. Any material that, in our judgment, is obscene or threatening is prohibited and will be removed from our servers with or without notice. Failure to respond to an email from our abuse department within 48 hours may result in the suspension or termination of your services. All abuse issues must be dealt with via support ticket/email and will have a response within 48 hours. If you are unsure about the acceptability of your site or service, please contact us at [email protected] and we will be happy to assist you. Potential harm to minors, including but not limited to child pornography or content perceived to be child pornography, is strictly forbidden. Any site found to host child pornography or linking to child pornography will be suspended immediately without notice. Violations will be reported to the appropriate law enforcement agency.

Zero Tolerance Spam Policy

We take a zero-tolerance stance against sending unsolicited e-mail, bulk emailing, and spam. "Safe lists" and "double opt-in" will be treated as spam. Any user who sends out spam will have their account terminated with or without notice. Sites advertised via SPAM (Spamvertised) may not be hosted on our servers. This provision includes but is not limited to SPAM sent via fax, email, instant messaging, or usernet/newsgroups. No organization or entity listed in the ROKSO may be hosted on our servers. Any account that results in our IP space being blacklisted will be immediately suspended and/or terminated. RDPHosted, LLC reserves the right to require changes or disable as necessary any RDP Servers, Account, VPS, or other component that does not comply with its established policies or to make any such modifications in an emergency at its sole result in a late fee and/or service suspension until account balance has been paid in full.

Fraudulent activity

In the event of any chargeback or payment dispute, you will be immediately suspended from all services provided by RDPHosted, LLC. We also reserve the right to suspend your account while investigating fraud. In case of fraudulent activities, RDPHosted, LLC reserves the right to share any or all of the user’s personal information with the necessary authorities for investigation.

Refusal of Service

We reserve the right to refuse service to anyone at any time for any reason. Any material that, in our judgement, is obscene or threatening is prohibited and will be removed from our servers with or without notice. The user is responsible for backing up their data on their local device or any other external storage device. RDPHosted, LLC is not responsible for any data loss incurred due to server failure or server maintenance.

Modification of Terms of Service

RDPHosted, LLC reserves the right to modify these terms of service at any time without prior notice. The changes made will become effective once posted on the RDPHosted, LLC website. By continuing to use our services after the changes are made, you agree to be bound by the updated terms of service.

Indemnification

The customer agrees to indemnify and hold harmless RDPHosted, LLC and its employees from any claims resulting from the use of our services that damages the customer or any other party. This includes any direct or indirect damages arising from the use of our services.

Disclaimer

RDPHosted, LLC provides its services on an "as is" and "as available" basis. We do not warrant that our services will be uninterrupted, error-free or free from viruses or other harmful components. We disclaim all warranties of any kind, whether express or implied, including but not limited to, the implied warranties of merchantability, fitness for a particular purpose and non-infringement. We shall not be liable for any direct, indirect, incidental, special, consequential or exemplary damages, including but not limited to, damages for loss of profits, goodwill, use, data or other intangible losses (even if we have been advised of the possibility of such damages), resulting from the use or the inability to use our services.

Governing Law

These terms of service shall be governed by and construed in accordance with the laws of India, without giving effect to its conflict of law provisions.

Entire Agreement

These terms of service, along with the Service Descriptions and any other documents referenced herein, constitute the entire agreement between the customer and RDPHosted, LLC and supersede all prior or contemporaneous agreements, understandings, and communications, whether written or oral, relating to the subject matter of this agreement.

Assignment and Delegation

RDPHosted, LLC may assign or delegate its rights and obligations under this agreement without prior notice to the customer. The customer may not assign or delegate any of its rights or obligations under this agreement without the prior written consent of RDPHosted, LLC.

Headings

The headings in this agreement are for convenience only and shall not affect its interpretation.

Waiver and Severability

No waiver by RDPHosted, LLC of any term or condition set forth in these terms of service shall be deemed a further or continuing waiver of such term or condition or a waiver of any other term or condition, and any failure of RDPHosted, LLC to assert a right or provision under these terms of service shall not constitute a waiver of such right or provision. If any provision of these terms of service is held by a court or other tribunal of competent jurisdiction to be invalid, illegal, or unenforceable for any reason, such provision shall be eliminated or limited to the minimum extent such that the remaining provisions of the terms of service will continue in full force and effect.
