Acceptable Usage Policy

Welcome to RDPHosted, LLC Before using our services, please carefully review the following Acceptable Usage Policy. By using our services, you agree to be bound by this policy.

What is not allowed:

All services provided by RDPHosted, LLC may only be used for lawful practices and purposes. The laws applied are subject to Indian Government regulations. Transmission, storage, or presentation of any information, data or material in violation of any Indian State or City law is prohibited. Every customer agrees to indemnify and hold harmless RDPHosted from any claims resulting from the use of our services. In addition, the use of our services to infringe upon any copyright or trademark is adamantly prohibited. This includes but is not limited to unauthorized copying of music, books, photographs, or any other copyrighted material. The offer of sale of any counterfeit merchandise of a trademark holder will result in the immediate termination of your account. Banned Activities:

The following activities are banned for use on all our servers and may not be run by any customer(s) unless there is a written permission from us to do so. These activities are banned since they are either illegal/harmful/malicious/increase server loads.

• Any kind of IRC Bots
• DDoS/DoS/Brute Force tools
• Any kind of Email spamming tools like AMS or TurboMailer
• Hosting of Game Servers
• Hacking/Cracking/Carding
• Mail Bombers
• Any type of sniffers
• IP Spoofers
• Port Scanners
• Telnet or SSH Access Scripts
• All versions of UBB (Ultimate Bulletin Boards)
• Fake Login Pages
• Resource hogging software that takes CPU more than 25%

The following acts will be considered violations of the AUP:

Illegal Use: Includes, but is not limited to:

• Using the service in any way that violates Indian, State, Local, or International law
• Transmitting copyrighted material without authorization from the copyright holder
• Violating export control regulations
• Distributing copyrighted media without the authority to distribute or display
• File storage/image hosting/file repository/streaming/backup
• Child pornography or kidnapping material

Malicious Activity: Includes, but is not limited to:

• Willfully interfering with the regular operation of the Service
• Attempting to access any unauthorized system or services
• Hosting any deceptive material for the purposes of phishing
• Running any password cracking software
• Virus, Spyware, Malware, or other infectious material
• Running root exploit kits against other servers
• Distributing viruses, worms, or Trojan horses
• Forging or misrepresenting message headers in whole or in part
• Scanning networks
• Threatening or encouraging bodily harm or destruction of property
• Violating the rights of privacy or publicity of an individual

Promotion of Illicit Activity: Includes, but is not limited to:

• Any activities prohibited by Indian, State, Local, or International law
• Any activities that result in the spread of computer viruses or other damaging programs or data files
• Any activity or material protected by trade secret or other statute
• Fraudulent activity, phishing, pyramid schemes, chain letters, forgery, or impersonation
• Terrorist propaganda, racist material, or bomb/weapon instructions
• Hacking, cracking programs, or key generators
• Gambling
• Circumvention of copyright or patent protection
• Exposure of any trade secret

Unsolicited Bulk Electronic Mailing: This includes sending unsolicited commercial and bulk e-mails. The subscriber must only send bulk electronic mail to those who have specifically requested to receive such mail and must comply with all relevant laws governing the transmission of electronic mail.

Spaming and Related Activities: This includes posting commercial, political, or advertising posts to public forums, issuing unsolicited trackbacks for the purpose of promotion, providing DNS resolution in support of Unsolicited Bulk Electronic Mailing, and hosting a destination site linked from Unsolicited Bulk Electronic Mailing.

Abuse: This includes consistent overuse of shared resources to the detriment of other subscribers, operating an open proxy server or using the service as part of a proxy network, and using scripts commonly used for abuse, attacks, or flooding.

Insufficiently-Secure Administration: This includes the use of weak authentication methods, allowing unauthorized third parties to establish root or user-level access to the service provided by the service provider, and operating an open mail relay.

Miscellaneous: This includes not using excessive system resources, not running stand-alone, unattended server-side processes, not running any type of web spider or indexer, not running any software that interfaces with an IRC network, not running any bit torrent application, tracker, or client, not participating in any file-sharing/peer-to-peer activities, not running any gaming servers, and not running cron entries with intervals of less than 15 minutes. The hosting and distribution of copyrighted film music and other media is strictly prohibited on the service provider's servers. Additionally, users are responsible for ensuring that scripts and programs installed under their account are secure and have proper directory permissions. Finally, certain scripts and programs, such as IRC egg drops/scripts/bots, game servers, proxy servers, and mail bombers, are banned from use on the servers.

Torrent Activities: We strictly prohibit our clients from engaging in any kind of torrent activity, including leeching, downloading, or seeding, using public trackers. If a client chooses to use a public tracker, they do so at their own risk, and they will be solely responsible for any issues that arise. If we receive a complaint regarding a torrent, IP, or account associated with such activity, we will suspend the account immediately.

Specialized Hosting: We offer specialized hosting services, each of which is designed to work with specific scripts. For example, RapidLeech Hosting only permits the use of the RapidLeech script, and other similar or different scripts are not allowed. Similarly, sBorg Hosting is limited to the sBorg script, TFRL Hosting is designed for use with the TorrentFlux B4rt and RapidLeech scripts only, and Seedbox Hosting requires the use of ruTorrent/Transmission and RapidLeech.

DDoS or Attack Prevention: Our services do not include protection against DDoS or other network-based attacks. To obtain basic protection against such attacks, you should strengthen your VPS/server security. If your VPS/Server experiences an incoming or outgoing attack, please note the following policies:

INCOMING ATTACK on your VPS/Server: In the event of an attack, we will null-route your IP for 24 hours or more, and we will reactivate it only after we believe the attack has stopped. If the attack persists, we may null-route your IP for 72 hours or more, and if it continues after that, we will close your VPS/Server and provide you with a way to back up your data. We may also decide to stop providing any new services to you or close your account permanently if your services experience frequent attacks.

OUTGOING ATTACK from your VPS/Server: We strictly prohibit any network activity that involves DDoS or other attacks, port scanning, hacking/cracking activities, or similar activities on our network. If we discover that your services are involved in such activities, we will suspend them immediately and may close them permanently, depending on the severity of the attack.

Abuse Policy: We reserve the right to deny service to anyone. We prohibit any material that we consider obscene or threatening, and we will remove such material from our servers with or without notice. If our abuse department sends you an email and you fail to respond within 48 hours, your services may be suspended or terminated. All abuse issues must be handled via support ticket or email, and we will respond to them within 48 hours. We strictly prohibit any content that could harm minors, including but not limited to child pornography or content that appears to be child pornography (Lolita). Any site found to host or link to child pornography will be suspended immediately without notice, and violations will be reported to the appropriate law enforcement agency.
